PRIVACY POLICY.

BMW Group and THACO AUTO Group (“we”) take your personal information security seriously. We request that you read this privacy policy carefully as it contains important information on how we collect your personal information and how we will use your personal data.

To comply with Vietnamese laws and regulations on privacy, including but not limited to the Civil Code No. 91/2015/QH13, the Information Technology Law No. 67/2006/QH11, the Law on Information Security No. 86/2015/QH13, and the Cybersecurity Law No. 24/2018/QH14 (“the Laws”), we have appointed THACO AUTO DISTRIBUTION COMPANY LIMITED (“THACO AUTO”) as our representative to ensure compliance with the Laws in Vietnam and this privacy policy.

1. PERSONAL DATA WE MAY COLLECT ABOUT YOU.

a. We may collect personal data about you (such as your name, postal address, email address, phone number, credit card number and expiration date, financial details (e.g., income, expenses, and/or credit history), employment details (e.g., occupation, directorships, and other positions held, employment history, salary, and/or benefits)) whenever you visit or use our website, purchase any goods or services related to this Privacy Policy, or complete any forms (both online and offline).

b. For example, we will collect your personal data when you register to use the website, send feedback, post material, contact us for any reason, sign up for a service, enter a contest, event, or purchase goods or services.

c. We may monitor your use of this website through the use of cookies and similar tracking devices. For example, we may monitor how many times you visit, which pages you go to, traffic data, location data, and the originating domain name of a user's internet service provider. This information helps us build a profile of our users. Some of this data will be aggregated or statistical, which means that we will not be able to identify you individually. d. Occasionally, we may receive information about you from other sources (such as credit reference agencies) which we will add to the information we already hold about you in order to help us supply goods and services, improve and personalize our service to you.

e. If you are under 18 years old, please do not provide us with any information unless you have the permission of your parent or guardian to do so.

2. HOW WE USE YOUR PERSONAL DATA.

We will use your personal data for the purposes described in the privacy notice given to you at the time your data is obtained. These purposes may include:

  • To administer and manage requests for refunds of goods or services that you register by providing us with your information.
  • Administration.

5. DISCLOSURE OF PERSONAL DATA

a. Other companies within our group. b. Our agents and service providers (e.g., providers of web hosting or maintenance services). c. Credit reference agencies - please see the “Credit checking” section below. d. Law enforcement agencies in connection with any investigation to help prevent unlawful activity. e. Our business partners in accordance with the “Marketing and opting out” section above.

6. CREDIT CHECKING

To enable us and other companies in our group to make credit decisions about you and members of your household, and for fraud prevention and anti-money laundering purposes, we may search the files of credit reference and fraud prevention agencies (who will record the search). We may disclose information on how you manage your account to these agencies, and your information may be linked to records relating to other individuals living at the same address with whom you are financially linked. Other credit grantors may use this information to make credit decisions about you and the people with whom you are financially associated, as well as for fraud prevention, tracing debtors, and money laundering purposes.

7. TRANSFERRING YOUR DATA ABROAD

To the fullest extent permitted by the Laws, the information you provide may be transferred to countries outside Vietnam that may not have similar protections in place regarding your personal data and restrictions on its use as set out in this Privacy Policy. However, we will take steps to ensure adequate protections are in place to safeguard the security of your information. By submitting your information, you consent to these transfers for the purposes specified in this Privacy Policy.

8. KEEPING YOUR DATA SECURE

a. We will use technical and organizational measures to safeguard your personal data, for example:

  • Access to your account is controlled by a password and unique username for you.
  • We store your personal data on secure servers.

b. While we will use all reasonable efforts to safeguard your personal data, you acknowledge that the use of the Internet is not entirely secure, and for this reason, we cannot guarantee the security or integrity of any personal data that is transferred from you or to you via the Internet.

9. RETENTION OF YOUR PERSONAL DATA

We will cease to retain your personal data when the purpose for which the personal data was collected is no longer being served by retention of the personal data or retention is no longer necessary for our business or legal purposes.

10. INFORMATION ABOUT OTHER INDIVIDUALS

If you give us information on behalf of someone else, you confirm that the other person has appointed you to act on their behalf and agreed that you can:

  • Consent on their behalf to the processing of their personal data.
  • Receive on their behalf any data protection notices.
  • Consent to the transfer of their personal data abroad.
  • Consent to the processing of their sensitive personal data (e.g., health information).

11. USE OF COOKIES

a. A cookie is a small text file that is placed on your computer (or other electronic devices) when you access our website. We use cookies and other online tracking services on this website to:

  • Keep track of the items stored in your shopping basket and take you through the checkout process.
  • Recognize you whenever you visit this website (this speeds up your access to the site as you do not have to log in each time).

12. YOUR RIGHTS

You have the right to obtain information about your personal data stored by THACO AUTO Group and the right to request access to view any information held about you and request rectification, updates, erasure, or disablement at any time. Please contact us in writing (enclosed in an email) and send it to the contact address provided below and/or directly to the official BMW agent of THACO AUTO regarding this request. If you have any questions, objections, or complaints about the processing of your personal data, or if you wish to restrict the processing of your personal data for Optional Purposes, or if you wish to withdraw the consent you have voluntarily provided, please contact us in writing (enclosed in an email) at the contact address provided below and/or directly to the official BMW agent of THACO AUTO regarding this request.

13. PERSONAL DATA COLLECTED AND/OR PROCESSED BY OUR PARTNERS

You agree that your personal data may be collected and/or processed by our partners, especially our independent agents (not owned by THACO AUTO Group). They may have different privacy policies and practices regarding your personal data. We will request them to respect and protect your personal data reasonably, but we will not be responsible for any of their policies and/or practices.

14. BUSINESS TRANSITIONS

If a BMW or THACO AUTO-related business is sold or merged with another business, your details may be disclosed to our advisors and any prospective purchasers and their advisors and will be passed on to the new owners of the business.

15. YOUR CONSENT

By submitting your personal information, you consent to the use of that information as set out in this Privacy Policy.

16. CHANGES TO PRIVACY POLICY

We may change this Privacy Policy from time to time. You should check this Privacy Policy occasionally to ensure that you are aware of the most recent version that will apply each time you access this website.
